Welcome to RallyCrew! These Terms of Use (“Terms”) are a legal agreement between you and RallyCrew. They apply to your use of RallyCrew’s platform, including the website, mobile app, and any related services (collectively, the “Platform”).

By using RallyCrew, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Membership-Based Organization

RallyCrew is a membership-based organization. By creating an account, you agree to become a member of RallyCrew.

Membership is free, and it renews automatically each year unless you choose to cancel. Certain services or activities publicized on RallyCrew—such as insured courses or events—may only be available to current members.

2. Platform Use

RallyCrew is primarily a community platform. In most cases, we do not organize, operate, or supervise the courses, trips, instruction, or gear transactions that happen through the platform.

Unless specifically noted, RallyCrew is not the organizer or provider of the events or services listed on the platform.

This means:

  • We do not take responsibility for decisions made between users

  • We do not guarantee or certify the safety, legality, or quality of any offering

  • We do not offer medical, legal, or professional advice

You are responsible for your choices, interactions, and risk assessment across all areas of the platform.

3. User Responsibilities

You agree to:

  • Provide accurate information on your profile

  • Represent your skill level and certifications honestly

  • Post respectful and truthful content

  • Follow the RallyCrew Code of Conduct

You are responsible for any content you share, including event listings, messages, gear offers, and comments.

4. Personal Risk and Safety

Whitewater paddling is inherently risky. By using RallyCrew, you agree that:

  • You are solely responsible for your own safety

  • You will assess your skill level and determine if a trip or event is appropriate

  • You will follow all applicable local laws and safety regulations

  • You are responsible for wearing appropriate safety gear (helmet, life jacket, etc.)

RallyCrew assumes no liability for injuries, damages, or losses resulting from paddling-related activity or community interaction.

5. Instruction, Coaching, and Events

If you offer instruction, guide trips, or host events on RallyCrew, you are responsible for:

  • Accurately representing your qualifications

  • Complying with all local laws, permits, and insurance requirements

  • Providing accurate event descriptions, expectations, and limitations

RallyCrew is not responsible for the outcomes of events or instruction posted by users.

5A. Access to Insurance for Select Activities

RallyCrew may provide access to third-party insurance coverage for eligible courses or events hosted through the platform.

  • This insurance is offered by external providers. RallyCrew does not sell, underwrite, or manage insurance policies.

  • Access is available only for select, pre-approved activities, and eligibility requirements may apply.

  • Insurance is available to RallyCrew members only.

  • Details about coverage, requirements, and responsibilities will be provided as part of the application and approval process.

RallyCrew does not guarantee insurance availability and is not liable for the terms, scope, or outcome of any insurance coverage provided.

5B. RallyCrew-Hosted Events

From time to time, RallyCrew may directly organize and host events, such as community gatherings, clinics, or online workshops. These events will be clearly marked as RallyCrew-hosted, and participation may require agreeing to additional terms—such as a participant waiver or event-specific agreement.

Even in RallyCrew-organized events, participants remain responsible for their own safety, risk assessment, and personal equipment. RallyCrew assumes no liability beyond the scope of any event-specific documentation provided at the time of registration.

5C. Payment Collection and Course Payouts

For select insured courses hosted through the RallyCrew platform, RallyCrew may collect participant payments on behalf of the instructor or course organizer.

By listing a course through this system, instructors and event organizers agree that:

  • RallyCrew will collect all registration fees from participants

  • RallyCrew will deduct an insurance fee (where applicable), which is retained by RallyCrew

  • A payment processing fee may also be deducted from the total amount collected

  • The remaining balance will be forwarded to the instructor or organizer, typically via ACH or another agreed-upon method

Payout terms may vary by provider on a case-by-case basis. RallyCrew reserves the right to revise fee structures and payout processes at any time. Payout timelines may vary depending on course timing, payment settlement, and verification of course delivery.

Instructors are responsible for complying with any applicable tax, licensing, or regulatory requirements associated with their payouts.

6. Gear Lending, Sales, or Rentals

If you lend, rent, donate, or sell gear via RallyCrew, you do so at your own risk. RallyCrew does not inspect, verify, or guarantee the condition or delivery of any equipment.

Any disputes related to gear exchanges must be resolved directly between users.

7. Community Standards and Account Management

All users are expected to follow the RallyCrew Code of Conduct. RallyCrew reserves the right to:

  • Suspend or remove accounts at any time

  • Remove or restrict content that violates our standards

  • Block access to users who undermine safety, trust, or platform integrity

8. Pricing and Fees

RallyCrew is currently free to use. However, we reserve the right to introduce new features, services, or membership levels that may require payment in the future.

If we introduce paid features:

  • We’ll give you clear advance notice

  • You’ll always be able to opt in (or out)

  • All fees will be transparently disclosed at the time of purchase

RallyCrew may also offer premium plans or services for businesses, instructors, or organizations.

9. Communication and Notifications

By creating an account, you consent to receive emails and in-app notifications related to your RallyCrew activity, such as event invites, trip messages, safety updates, and platform news.

You can manage your communication preferences at any time in your account settings.

10. Privacy

We respect your privacy. Please review our Privacy Policy for a full explanation of what we collect, how we use it, and how we protect your data.

11. Changes to the Terms

We may update these Terms of Use from time to time. If we make material changes, we’ll notify you through the app, website, or email. Continued use of RallyCrew after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Oregon, United States. You agree that any disputes will be resolved in Oregon courts unless we mutually agree to an alternative.

13. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will still apply.

14. Intellectual Property

All content on RallyCrew—including branding, platform design, and original content—is the property of RallyCrew or its licensors.

You retain ownership of your user-generated content but grant RallyCrew a royalty-free, worldwide license to display, share, and promote your content in connection with platform services.

15. Prohibited Activities

You agree not to:

  • Impersonate others or create fake profiles

  • Harass, abuse, or threaten others

  • Post misleading or harmful information

  • Use bots or scripts to access or interfere with the platform

  • Use RallyCrew to conduct unlawful or unethical activity

Violation of these rules may result in immediate account termination.

16. Third-Party Links and Content

RallyCrew may include links to third-party websites or tools. We are not responsible for the content, policies, or services offered by those third parties.

17. Indemnification

You agree to indemnify and hold harmless RallyCrew, its officers, employees, and affiliates from any claims or damages arising from:

  • Your use of the platform

  • Your content or conduct

  • Your interactions with other users or third parties

18. Limitation of Liability

To the fullest extent permitted by law, RallyCrew is not liable for indirect, incidental, or consequential damages. Our total liability, if any, is limited to the amount you paid (if any) to use the platform in the past 12 months.

19. Force Majeure

We are not responsible for delays or failures caused by events beyond our control, including natural disasters, network outages, acts of war, or civil disturbances.

20. Termination

RallyCrew may suspend or delete your account at any time, without notice, for any reason. Upon termination, you may lose access to your content and profile.

21. Dispute Resolution

If you have a concern or dispute, we encourage you to contact us first for a friendly resolution.

If that’s not possible:

  • Disputes will be resolved in Oregon courts unless both parties agree to an alternative

  • RallyCrew may, at its discretion, require binding arbitration under the rules of the American Arbitration Association

  • You waive the right to participate in any class action or class arbitration against RallyCrew

Nothing in this section affects your rights under applicable local law.
